- A 57-year-old woman was overcome by carbon monoxide.
- A 66-year-old man was riding his bicycle when he was struck by a car.
- A businessman was traveling home was hit head-on by a drunk driver.
- A woman in her fifties was struck from behind by a SUV.
CASE DESCRIPTION: A six-year-old boy was following his brother across the street when he was struck by a car that had been leased by a woman who lived in the area. The driver of the car had no insurance of her own, but the family was able to make a claim against the car rental company.
The child sustained traumatic brain injuries and multiple fractures. He was hospitalized for 6 months, required extensive physical therapy, occupational therapy and was left with permanent cognitive and physical impairments. The firm worked closely with the family, the child’s doctors and therapists for several years to assist in his recovery.
CASE RESULT: The case was settled after suit for $1,000,000.00 which was the limit of insurance coverage available to the car rental company. The firm assisted the family in deciding upon a structured settlement to provide for future payments to their son.
CASE DESCRIPTION: A 57-year-old woman was overcome by carbon monoxide in the apartment she had been renting. An investigation revealed that the landlord had not serviced the furnace for many years which allowed rust to develop in the baffles. This prevented the heating system from operating normally causing a build-up of carbon monoxide that circulated into the client’s apartment.
The woman suffered carbon monoxide poisoning which caused permanent brain injuries, leaving her with depression, difficulty concentrating, memory loss and disability from work.
CASE RESULT: The case was settled after suit for $450,000.00.
CASE DESCRIPTION: A 66-year-old man was riding his bicycle home from work when he was struck by a car. The client was hospitalized for several days and then released. He began suffering from headaches and having problems with his vision. During an eye examination a few weeks after the accident his doctor found evidence of increased pressure in the eyes and recommended a CT scan. The scan demonstrated a subdural hematoma which required surgery. The client was out of work for several months, and although he recovered well from his physical injuries, he has been left with severe headaches, as well as concentration and memory loss.
CASE RESULT: The case was settled after suit for $425,000.
CASE DESCRIPTION: A businessman was traveling home from work in the late afternoon when he was hit head-on by a drunk driver. The client suffered multiple fractures to his leg requiring extensive surgeries.
CASE RESULT: There was only $20,000 of insurance coverage for the drunk driver that was promptly paid by his insurance carrier. Our firm helped get the client’s medical bill paid by his workers’ compensation carrier. Through mediation, $500,000.00 was paid by the client’s own automobile insurance carrier. An additional $250,000.00 was paid by the workers’ compensation carrier which resulted in total payments of $770,000.00.
CASE DESCRIPTION: A woman in her fifties was waiting to turn left into the driveway where she worked when she was struck from behind by a SUV traveling approximately 40 miles per hour. She sustained neck and back injuries. Although she does not recall losing consciousness from the accident, she was diagnosed as sustaining a traumatic brain injury which resulted in memory and concentration problems leading to a reduction in her earnings.
CASE RESULT: The case settled prior to suit for the policy limit of $300,000.00, which included payments for the client’s personal injuries and property damage.
